IstaNet Website Hosting Service - Terms of Service

This text constitutes a legal document of the terms of service for IstaNet website hosting services.

These terms concern the provision of website hosting, email and related internet services by IstaNet through the website www.istanet.gr.

Access to www.istanet.gr, account creation, order submission or use of any IstaNet hosting service constitutes full and unconditional acceptance of these terms.

IstaNet, hereinafter referred to as the “Company”, provides website hosting, email, database, SSL certificate, technical support and related internet services.

Users, visitors, subscribers, customers or customer representatives using the Company’s website or services shall be referred to herein as the “Customer”.

If the Customer does not agree with any of these terms, the Customer must not use the Company’s services.

The Company reserves the right to modify these terms at any time. Use of the services after publication of modified terms constitutes acceptance by the Customer.

Use of services

The Customer must use the services in accordance with Greek and European law, good faith, good morals and acceptable internet use rules.

The Customer must refrain from any illegal, abusive, harmful, misleading or technically dangerous use of the services.

The Customer is solely responsible for the content, files, code, applications, databases, emails, personal data and any information stored or transmitted through the Company’s hosting services.

The Company has the right to suspend or terminate services if it identifies a breach of these terms or usage that endangers the infrastructure, other customers or third parties.

Hosting services

Hosting services are provided according to the technical specifications of each package.

The resources of each account are intended for the normal operation of websites, email and applications belonging to the Customer.

Using the services as backup storage, file sharing, streaming, mirror, download archive or general file repository not directly related to the website is prohibited.

The Company reserves the right to impose technical limits on CPU, RAM, Disk IO, bandwidth, email sending, inodes and other resources in order to ensure service stability.

Backups

The Company may keep backups of hosting services according to its technical policy.

Backups are provided as an auxiliary measure and do not release the Customer from the obligation to maintain independent and up-to-date backups.

The Customer is solely responsible for creating, storing and verifying their own backups.

The Company does not guarantee that any backup will be available, complete, recent or technically restorable.

Payments, renewals and financial terms

Hosting services are prepaid according to the billing cycle selected by the Customer or stated in the package.

Prices are listed in euros and do not include VAT unless otherwise stated.

The Company may provide payment by bank transfer, card, electronic payment methods or other methods displayed on www.istanet.gr.

Any bank fees, transaction fees or third-party commissions are borne by the Customer unless otherwise stated.

Service activation takes place after payment confirmation, unless otherwise agreed.

The Company shall not be liable for activation delays due to failed payment, unidentified bank deposit, bank issue or incorrect payment details.

Where automatic renewal is available, the Customer may choose renewal via stored payment method or account credit.

The Customer may disable automatic renewal through the client area or by written request, where supported.

If the Customer does not wish to renew a service, the Customer must notify the Company in time before the renewal date.

For VPS and dedicated servers, written cancellation notice of at least 30 days before the next renewal may be required, where stated in the package or offer.

In case of non-payment, the Company may suspend, terminate or delete the service after the payment period or grace period has expired, where applicable.

Billing and price changes

The Company reserves the right to modify prices, packages, features and technical specifications for future purchases or renewals.

The Customer is responsible for checking the renewal cost before each payment.

Any offers, discounts or promotional prices apply only for the period and terms expressly stated.

Cancellations and refunds

The Customer may request service termination by written request to the Company.

Service termination upon Customer request does not automatically create a right to refund for the remaining prepaid period.

The Company may, at its discretion or according to a published commercial policy, provide credit or refund for specific services.

Amounts are not refundable for already executed services, special technical work, domain names, SSL certificates, dedicated IP, software licenses, additional third-party services or services purchased by special order.

The Company may provide a money-back guarantee for specific hosting packages, where expressly stated in the package description.

If a money-back guarantee is not expressly stated, no such right is considered to be provided.

In order for a refund request to be examined, the Customer must submit a written request and state the reason for dissatisfaction.

Violation of these terms, abuse of services, spam sending, hosting illegal content or excessive resource usage may result in rejection of a refund request.

If a refund or credit is approved, the Company informs the Customer in writing.

Refund processing time may vary depending on the payment method, bank or payment provider.

Security, resource usage and prohibited actions

Hosting, storing, publishing or transmitting content that infringes copyright, contains pirated software, movies, music, books or serial numbers, includes hacking tools, warez, phishing or malware, is racist, defamatory, abusive, threatening or illegal, concerns illegal activities, violates third-party personal data, misleads users or third parties, or endangers systems, networks or accounts is prohibited.

The Company has the right to reject, disable, isolate, delete or request deletion of material that violates these terms or the law.

In serious cases, the Company may immediately suspend the service without prior notice.

The following are strictly prohibited: spam sending, mail bombing, phishing, spoofing, port scans, ping floods, packet spoofing, denial of service attacks, sniffers, flooding, installation or distribution of viruses, IRC bots, web shells, PhpShell or similar scripts, crypto mining, botnets, authentication bypass, unauthorized system access, network compromise and execution of unauthorized background processes.

The existence of such tools, even if not actively running, may lead to account suspension or termination.

Email and spam

Sending unsolicited bulk email, known as spam, is prohibited.

Using email services for phishing, spoofing, misleading messages, malicious attachments or bulk mailings that violate the law is prohibited.

The Company may temporarily limit or suspend email services when there is suspicion of abuse, account compromise, spam or blacklisting.

SSL and technical security

The Company provides or intermediates the issuance of SSL certificates through cooperating providers or certificate authorities.

Issuance, renewal, reissue or revocation of an SSL certificate depends on the terms of the respective certificate authority.

For free certificates, such as Let’s Encrypt, the Company does not guarantee uninterrupted availability.

Customer responsibility, content and limitation of liability

The Company does not perform prior control of content uploaded, stored or transmitted through the Customer’s services.

The Company does not guarantee the accuracy, reliability, quality or legality of any information appearing online through the Customer’s services.

The Customer is solely responsible for any information, product, service, promise, offer, commercial transaction or communication carried out through the Customer’s website.

The Company shall not be liable for damages suffered by the Customer or any third party due to the content, products, services or transactions carried out through the Customer’s website.

The Company makes reasonable effort to provide reliable services but shall not be liable for any direct or indirect damage arising from use, interruption, delay or inability to use the services, unless otherwise provided by mandatory law.

The Company shall not be liable for loss of profits, loss of customers, data loss, reputational damage, business interruption, loss of opportunity or indirect damages.

The Company’s total liability, if any, is limited to the amount paid by the Customer for the service from which the claim arose.

The Company shall not be liable for damages caused by malicious third-party action, malware, credential compromise, vulnerabilities in the Customer’s applications, incorrect DNS settings, third-party provider issues or incorrect handling by the Customer.

The Customer agrees to protect, indemnify and hold the Company harmless from any claim, damage, fine, expense, cost or third-party claim arising from the Customer’s use of the services.

Personal data, privacy and abuse reports

The Company processes the Customer’s personal data for service provision, billing, technical support, security, communication and legal compliance.

The Customer is responsible for third-party personal data stored or processed through the hosting services.

If the Customer uses the service to process third-party personal data, the Customer must comply with GDPR and all applicable legislation.

The Company takes reasonable technical and organizational security measures, without guaranteeing absolute security against every threat.

Reports of abuse, illegal content, spam, phishing, malware or rights infringement may be sent to abuse@istanet.gr or through the corresponding contact form on www.istanet.gr.

Each report must include a clear description, URL or domain, evidence and the reporter’s contact details.

The Company reviews reports and may take technical or administrative measures where it deems necessary.

Cookies

The website may use cookies and similar technologies for proper operation, security, user experience improvement and, where required, statistical or commercial purposes.

The Customer may configure cookie use through their browser or through an available consent mechanism, where provided.

General policies, service expiration and business details

After a service expires, the Company may suspend its operation.

If the service remains unpaid, the Company may permanently delete it, including files, databases, emails, settings and backups.

The Customer is responsible for renewing services on time and maintaining their own backups.

The Company shall not be liable for data loss due to non-payment, non-renewal or deletion of an expired service.

Use of www.istanet.gr, account creation, service payment, hosting activation or use of any Company service constitutes full acceptance of these terms.

Each online order is considered submitted after the Customer has been informed of and accepted these terms.

If any term is found invalid or unenforceable, this shall not affect the validity of the remaining terms.

These terms are governed by Greek Law.

Any dispute arising from the interpretation or application of these terms shall fall under the jurisdiction of the Greek courts, unless otherwise provided by mandatory law.
